{"id":837,"date":"2011-06-03T16:18:39","date_gmt":"2011-06-03T21:18:39","guid":{"rendered":"http:\/\/blogs.law.columbia.edu\/climatechange\/?p=837"},"modified":"2012-01-31T15:04:52","modified_gmt":"2012-01-31T20:04:52","slug":"new-jersey-governor-announces-withdrawal-from-rggi","status":"publish","type":"post","link":"https:\/\/blogs.law.columbia.edu\/climatechange\/2011\/06\/03\/new-jersey-governor-announces-withdrawal-from-rggi\/","title":{"rendered":"New Jersey Governor Announces Withdrawal from RGGI"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>By Julia Ciardullo<br \/>\nFellow<\/p>\n<p>On May 26, 2011, New Jersey Governor Chris Christie <a href=\"https:\/\/www.youtube.com\/watch?v=R-qMoqAfViM\" target=\"_blank\">announced<\/a> that New Jersey will withdraw from the Regional Greenhouse Gas Initiative (\u201cRGGI\u201d) by the end of the year.\u00a0 RGGI is a regional cap-and-trade system encompassing 10 Northeast and Mid-Atlantic states.[1]<\/p>\n<p>Governor Christie\u2019s authority to withdraw arises from the <a href=\"https:\/\/www.rggi.org\/design\/history\/mou\" target=\"_blank\">Memorandum of Understanding<\/a> (\u201cMOU\u201d) signed by the governors of the participating states.\u00a0 Section 5B of the MOU provides that, \u201c[a] Signatory State may, upon 30 days written notice, withdraw its agreement to this MOU and become a Non-Signatory State.\u201d<\/p>\n<p>However, the process for withdrawal does not end with Governor Christie\u2019s announcement.\u00a0 As required by the MOA, New Jersey adopted administrative rules for the state\u2019s component of the CO2 Budget Trading Program (<a href=\"https:\/\/www.state.nj.us\/dep\/aqm\/27C.pdf\" target=\"_blank\">N.J.A.C. 7:27C<\/a>).\u00a0 To repeal this rule, the appropriate agency must give at least 30 days\u2019 notice and afford all interested persons a reasonable opportunity to submit comments (<a href=\"https:\/\/law.onecle.com\/new-jersey\/52-state-government-departments-and-officers\/14b-4.html\" target=\"_blank\">N.J. Stat. \u00a7 52:14B-4<\/a>).\u00a0<\/p>\n<p>The more interesting question is what will happen to A-4559, the law adopted by the New Jersey State Legislature to implement RGGI (codified at <a href=\"https:\/\/www.njleg.state.nj.us\/2006\/Bills\/PL07\/340_.HTM\" target=\"_blank\">P.L.2007, c.340<\/a>).\u00a0 Despite New Jersey\u2019s technical withdrawal from RGGI, A-4559 would remain on the books unless the New Jersey State Legislature took action to repeal it.<\/p>\n<p>Governor Christie\u2019s announcement is not the first time New Jersey politicians have threatened to withdraw from RGGI.\u00a0 Earlier this year, Republican members of the New Jersey State Legislature introduced legislation \u2013 <a href=\"https:\/\/www.njleg.state.nj.us\/2010\/Bills\/S2500\/2250_I1.HTM\" target=\"_blank\">S-2250<\/a> in the Senate and <a href=\"https:\/\/e-lobbyist.com\/gaits\/text\/60052\" target=\"_blank\">A-3147<\/a> in the Assembly \u2013 that would not only repeal the relevant provisions of A-4559, but would also repeal the \u201cGlobal Warming Response Act\u201d (codified at <a href=\"https:\/\/www.njleg.state.nj.us\/2006\/Bills\/PL07\/112_.HTM\" target=\"_blank\">P.L.2007, c.112<\/a>), which requires the state to reduce greenhouse gas emissions 20 percent by 2020 and 80 percent by 2050.\u00a0 Passage of S-2250 and A-3147 would secure New Jersey\u2019s withdrawal from RGGI, making it more difficult for future politicians to restore the state\u2019s participation.<\/p>\n<p>Two Democratic Assemblymen, John F. McKeon and Upendra J.
