{"id":7759,"date":"2022-02-09T14:24:19","date_gmt":"2022-02-09T19:24:19","guid":{"rendered":"http:\/\/blogs.law.columbia.edu\/climatechange\/?p=7759"},"modified":"2022-02-09T14:24:19","modified_gmt":"2022-02-09T19:24:19","slug":"new-jersey-board-of-public-utilities-should-join-new-york-and-other-states-engaging-in-long-term-planning-to-get-off-of-gas","status":"publish","type":"post","link":"https:\/\/blogs.law.columbia.edu\/climatechange\/2022\/02\/09\/new-jersey-board-of-public-utilities-should-join-new-york-and-other-states-engaging-in-long-term-planning-to-get-off-of-gas\/","title":{"rendered":"New Jersey Board of Public Utilities Should Join New York and Other States Engaging in Long Term Planning To Get Off of Gas"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><em>By Jennifer Danis<\/em>,<\/p>\n<p>Yesterday, the Sabin Center, Environmental Defense Fund, and New Jersey Conservation Foundation submitted <a href=\"https:\/\/climate.law.columbia.edu\/sites\/default\/files\/content\/docs\/comments%20and%20legal%20briefs\/CommentsofSabinCenterEDFandNJCFtoNJBPUGasCapacityProceeding2-8-2022.pdf\">comments<\/a> to the New Jersey Board of Public Utilities (\u201cBPU\u201d) proceeding investigating the state\u2019s current and mid-term future supply and demand for gas. (<a href=\"https:\/\/publicaccess.bpu.state.nj.us\/CaseSummary.aspx?case_id=2108859\">NJBPU Docket GO20010033<\/a>.) The comments recommend that BPU commence a long-term gas planning proceeding, and require gas utilities to seek prior approval before taking contracts supporting new pipeline capacity.<\/p>\n<p>In response to ongoing dialogue with energy experts and advocates and state gas utilities, the BPU retained an independent expert, London Economics, International (\u201cLEI\u201d), to study whether New Jersey gas distribution utilities needed additional fossil fuel pipeline capacity to serve their customers. LEI\u2019s conclusion that no new capacity was needed was unsurprising to clean energy experts and advocates, but ran contrary to state gas utilities\u2019 claims. Now, formalizing data and analyses showing no new gas capacity is needed through this regulatory proceeding provides a clear signal to gas utilities that their days of unchecked infrastructure-based growth are over. It is critical that BPU quickly provides clear guidance and frameworks to its gas utilities to help them chart their paths forward, as other states are beginning to do, through an open and transparent gas supply planning proceeding.<\/p>\n<p>As the Regulatory Assistance Project has <a href=\"https:\/\/www.raponline.org\/wp-content\/uploads\/2021\/05\/rap-anderson-lebel-dupuy-under-pressure-gas-utility-regulation-time-transition-2021-may.pdf\">explained<\/a>, state public utility commissions have significant work to do to realign their historic roles with state laws requiring greenhouse gas reductions and clean energy transitions. The New York Public Service Commission is well underway in its process attempting to do just that; and <a href=\"https:\/\/www.nysenate.gov\/newsroom\/press-releases\/liz-krueger\/krueger-may-fahy-introduce-gas-transition-affordable-energy-act\">new state legislation is being proposed<\/a> to both support and expedite the energy transition. The situation in New Jersey is different: while New Jersey\u2019s BPU has a <a href=\"https:\/\/lis.njleg.state.nj.us\/nxt\/gateway.dll?f=templates&amp;fn=default.htm&amp;vid=Publish:10.1048\/Enu\">statutory mandate<\/a> to ensure that its utilities are serving customers in a manner that conserves and preserves the environment, in many ways, this legislative command has laid dormant and not been operationalized.<\/p>\n<p>The Sabin Center, Environmental Defense Fund, and New Jersey Conservation Foundation have taken an active role in these proceedings to recommend next steps for BPU to take based on LEI\u2019s conclusion that New Jersey\u2019s gas distribution utilities do not need any additional supply capacity out to 2030, so long as they undertake proper planning. Why is planning so essential? It\u2019s not just to meet climate and clean energy goals \u2013 although meeting those are critical. It\u2019s also to ensure that ratepayers don\u2019t end up footing the bill for infrastructure that is not only unnecessary to meet demand, but continues to push climate and clean energy goals out of reach. Low and moderate income ratepayers \u2013 those who are least able to be early adopters of clean energy technology, and who disproportionally suffer from climate change\u2019s worst impacts \u2013 will be increasingly at risk without BPU taking an active role in utility planning for gas transition.
