{"id":6646,"date":"2020-01-09T10:26:07","date_gmt":"2020-01-09T15:26:07","guid":{"rendered":"http:\/\/blogs.law.columbia.edu\/climatechange\/?p=6646"},"modified":"2023-02-24T13:19:31","modified_gmt":"2023-02-24T18:19:31","slug":"municipal-natural-gas-bans-round-1","status":"publish","type":"post","link":"https:\/\/blogs.law.columbia.edu\/climatechange\/2020\/01\/09\/municipal-natural-gas-bans-round-1\/","title":{"rendered":"Municipal Natural Gas Bans: Round 1"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>&nbsp;<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-6647 alignright\" src=\"https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2020\/01\/appliance-2257_1920-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2020\/01\/appliance-2257_1920-300x200.jpg 300w, https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2020\/01\/appliance-2257_1920-768x512.jpg 768w, https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2020\/01\/appliance-2257_1920-1024x683.jpg 1024w, https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2020\/01\/appliance-2257_1920.jpg 1920w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>In July 2019, Berkeley, California made news with the <a href=\"https:\/\/www.google.com\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=3&amp;ved=2ahUKEwjL37a6keDmAhXOuVkKHZ7uARoQFjACegQIAxAC&amp;url=https%3A%2F%2Fwww.cityofberkeley.info%2FClerk%2FCity_Council%2F2019%2F07_Jul%2FDocuments%2F2019-07-09_Item_21_Adopt_an_Ordinance_adding_a_new.aspx&amp;usg=AOvVaw3eANARk121CjWI6LoXtsd3\">first-ever municipal ban on new natural gas hookups<\/a> in the U.S. Hailed as \u201c<a href=\"https:\/\/www.latimes.com\/opinion\/story\/2019-07-30\/berkeley-natural-gas-ban\">momentous<\/a>\u201d and a \u201c<a href=\"https:\/\/www.theguardian.com\/environment\/2019\/jul\/23\/berkeley-natural-gas-ban-environment\">landmark move<\/a>,\u201d Berkeley\u2019s ordinance inspired other municipalities in California and beyond to consider and enact similar bans. At latest count, <a href=\"https:\/\/www.sierraclub.org\/articles\/2019\/12\/forward-looking-cities-lead-way-gas-free-future\">more than 50 municipalities<\/a> \u2013 mostly in California and Massachusetts \u2013 have considered or enacted an all-electric requirement for new construction. Though they differ in their details \u2014 some exempt uses such as cooking ranges, laboratories and more; some include major renovations in addition to new construction \u2014 these bans are largely aligned with local climate action planning and municipal goals to reduce greenhouse gas emissions. They are also giving rise to legal questions and challenges. This post offers a quick survey of the state of play.<\/p>\n<p><strong>Authority under applicable state law<\/strong><\/p>\n<p>The bans in California and Massachusetts rely on different sources of authority. Many of the California bans are structured as amendments to the local building codes. In that state, municipalities are permitted to adopt building energy code provisions that are more stringent than the state code with California Energy Commission approval. San Jose, Menlo Park, San Mateo, West Hollywood and Santa Monica, and Marin County <a href=\"https:\/\/www.sfchronicle.com\/business\/article\/California-regulators-clear-way-for-natural-gas-14900008.php\">have obtained this approval<\/a>, while other municipalities have proposals pending before the Commission. Berkeley took a different approach, relying on its local police powers to ban natural gas connections, and <a href=\"https:\/\/morganhillca.iqm2.com\/Citizens\/Detail_LegiFile.aspx?Frame=&amp;MeetingID=1821&amp;MediaPosition=2725.237&amp;ID=2508&amp;CssClass=\">the city of Morgan Hill followed Berkeley\u2019s lead<\/a>. Berkeley later supplemented its police power ban with <a href=\"https:\/\/www.cityofberkeley.info\/uploadedFiles\/Planning_and_Development\/Level_3_-_Energy_and_Sustainable_Development\/Berkeley%20Energy%20Reach%20Code%20for%20Electrification%20and%20Natural%20Gas%20Prohibition%209-27-19.pdf\">updates to th<\/a><a href=\"https:\/\/www.cityofberkeley.info\/uploadedFiles\/Planning_and_Development\/Level_3_-_Energy_and_Sustainable_Development\/Berkeley%20Energy%20Reach%20Code%20for%20Electrification%20and%20Natural%20Gas%20Prohibition%209-27-19.pdf\">e local building energy code<\/a> (still <a href=\"https:\/\/efiling.energy.ca.gov\/GetDocument.aspx?tn=231286-3&amp;DocumentContentId=62975\">pending approval before the CEC<\/a>).<\/p>\n<p>In Massachusetts, where municipalities generally do not have the authority to augment the state building energy code, the tension between state and municipal authority takes a different form. Brookline\u2019s ban relies on its \u201c<a href=\"https:\/\/malegislature.gov\/Laws\/GeneralLaws\/PartI\/TitleVII\/Chapter40\/Section21\">its home rule powers and its police powers<\/a>\u201d under Massachusetts law, which include the authority to \u201cdirect[] and manag[e] their prudential affairs\u201d and to \u201cregulat[e] the inspection, materials, construction, installation, alteration or use of pipes, fittings and fixtures through which gas is supplied within buildings.\u201d Because Brookline is a town, <a href=\"https:\/\/malegislature.gov\/Laws\/GeneralLaws\/PartI\/TitleVII\/Chapter40\/Section32\">Massachusetts law requires<\/a> that it submit the by-law implementing the ban to the state attorney general\u2019s office for approval, which is pending.<\/p>\n<p>Massachusetts cities, which are not subject to the same attorney general approval as towns, also face unresolved questions about their authority to implement natural gas bans. The Cambridge city attorney shared <a href=\"https:\/\/insideclimatenews.org\/news\/12122019\/natural-gas-ban-cities-legal-cambridge-brookline-massachusetts-state-law-berkeley-california\">her office\u2019s view<\/a> with the city\u2019s council that the a ban on new natural gas hookups would be preempted by state building code law. This has not deterred some city lawmakers, including a Cambridge city council member <a href=\"https:\/\/insideclimatenews.org\/news\/12122019\/natural-gas-ban-cities-legal-cambridge-brookline-massachusetts-state-law-berkeley-california\">who told Inside Climate News<\/a> that \u201cif this boils down to a fight in court over whether or not we ban gas, I welcome the fight.\u201d<\/p>\n<p>Other localities are waiting in the wings. The city of Newton appears poised to take the same tack as Cambridge, while the town of Lexington has indicated it will wait to see the outcome of the attorney general\u2019s review of the Brookline ban.<\/p>\n<p><strong>Court challenges<\/strong><\/p>\n<p>Not surprisingly, litigation has been filed to challenge these local government actions.<\/p>\n<p>In November, the California Restaurant Association sued the city of Berkeley seeking to enjoin that city\u2019s ban.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> The complaint claims that the Berkeley ban is preempted by the U.S. Energy Policy and Conservation Act, or EPCA, which preempts state and local promulgation of energy efficiency standards for certain household appliances such as furnaces, air conditioners, water heaters, dishwashers, clothes washers and dryers, kitchen ranges and ovens and more. (See 42 U.S.C. \u00a7\u00a7 6297(a) and 6292.) The California Restaurant association also claims in its suit that the Berkeley ban is preempted by the <a href=\"https:\/\/www.dgs.ca.gov\/BSC\/Codes#@ViewBag.JumpTo\">California Building Standards Code<\/a> and the <a href=\"https:\/\/www.energy.ca.gov\/programs-and-topics\/programs\/building-energy-efficiency-standards\">California Energy Code<\/a>, and that Berkeley should not have relied on its police power but rather pursued approval from the California Building Standards Commission or the California Energy Commission for an update to the building or energy code. As noted above, Berkeley has sought CEC approval for <a href=\"https:\/\/www.cityofberkeley.info\/uploadedFiles\/Planning_and_Development\/Level_3_-_Energy_and_Sustainable_Development\/Berkeley%20Energy%20Reach%20Code%20for%20Electrification%20and%20Natural%20Gas%20Prohibition%209-27-19.pdf\">an electrification component in its \u201creach code\u201d<\/a> to supplement the ban; it is not yet clear whether or how this will impact the litigation.<\/p>\n<p>The building code and energy code amendment approach is also being challenged in court. <a href=\"https:\/\/www.northbaybusinessjournal.com\/industrynews\/construction\/10382445-181\/windsor-california-natural-gas-construction-ban-lawsuit\">Two local home builders have filed suit<\/a><a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> against the town of Windsor, CA\u2019s ban \u2013 structured as an amendment to the local building energy code \u2013 \u00a0alleging, among other things, that the municipality failed to properly consider under the state\u2019s environmental review statute hazards and reliability concerns that could result from increased electrification, particularly in the face of increasing wildfires.<\/p>\n<p>These cases, though in preliminary stages, may influence future municipal efforts and the lawsuits challenging them.<\/p>\n<p><strong>More opposition<\/strong><\/p>\n<p>Municipal natural gas bans offer an area ripe for continued opposition by the natural gas industry and others. An <a href=\"https:\/\/www.bostonglobe.com\/metro\/2019\/11\/20\/first-for-massachusetts-brookline-votes-ban-oil-and-gas-pipes-new-buildings\/24RdqjUOldI5qrqF6zfiHP\/story.html\">industry group has indicated it will file suit<\/a> challenging the Brookline, MA ban. Some environmental advocacy organizations <a href=\"https:\/\/www.kqed.org\/news\/11788199\/environmentalists-say-natural-gas-industry-behind-restaurant-groups-challenge-to-berkeley-gas-ban\">have suggested that natural gas interests may be behind the California Restaurant Association suit<\/a> in Berkeley. Natural gas groups are also intervening at the local level. For example, <a href=\"https:\/\/www.huffpost.com\/entry\/massachusetts-natural-gas-ban_n_5de93ae2e4b0913e6f8ce07d\">opposition letters came in from such groups<\/a> in the days before the Brookline vote. A California gas company <a href=\"https:\/\/www.latimes.com\/environment\/story\/2019-10-22\/southern-california-gas-climate-change\">has also apparently funded \u201cgrass-roots\u201d anti-ban advocacy<\/a> in that state as well. Other interest groups have also expressed reservations about these natural gas bans, <a href=\"https:\/\/www.seattletimes.com\/seattle-news\/politics\/seattle-slows-proposed-ban-on-new-natural-gas-buildings-heating-oil-tax-advances\/\">leading Seattle to table voting on a proposed ban<\/a> there while it considers input from labor and industry groups. Given the essential interest of the natural gas industry in maintaining the ability to connect to new customers, we are sure to continue seeing anti-ban advocacy during the lawmaking process and in the courts.<\/p>\n<p><em>The Cities Climate Law Initiative is continuing to monitor developments in the promulgation of municipal bans on new natural gas hookups and related litigation in order to help advise municipalities on structuring such bans, or electrification requirements, in their jurisdictions.<\/em><\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> Cal.
