That lawsuit seeks compensation from BP, Exxon and other companies for climate change-related harms and the costs of adaptation.<\/p>\n<p><a href=\"https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2018\/11\/800px-ExxonMobil_Polderdijkweg_foto_1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-6115\" src=\"https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2018\/11\/800px-ExxonMobil_Polderdijkweg_foto_1-300x169.jpg\" alt=\"\" width=\"300\" height=\"169\" srcset=\"https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2018\/11\/800px-ExxonMobil_Polderdijkweg_foto_1-300x169.jpg 300w, https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2018\/11\/800px-ExxonMobil_Polderdijkweg_foto_1-768x432.jpg 768w, https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2018\/11\/800px-ExxonMobil_Polderdijkweg_foto_1.jpg 800w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>As noted in the brief, these prominent national local government associations, whose members represent the majority of the nation&#8217;s population, have a particular perspective on the question of whether state or federal law applies:<\/p>\n<p>&#8220;Local Government Amici have an interest in the Court\u2019s proper recognition of the existence and availability of state common law claims for climate change impacts. The district court\u2019s conversion of Plaintiff\u2019s state common law claims to federal common law claims and the subsequent dismissal of those converted federal common law claims threatens to intrude upon municipal governments\u2019 authority, within our federalist system, to rely on state law to seek redress for harms that, in a contemporary world defined by complex economic and environmental systems that transcend multiple borders, arise in significant part beyond their jurisdictions but nonetheless have highly localized impacts.&#8221;<\/p>\n<p>A number of other groups filed briefs, including <a href=\"https:\/\/www.nrdc.org\/sites\/default\/files\/amicus-brief-supporting-nycs-claims-against-bp-chevron-conocophillips-exxon-mobil-and-royal-dutch-shell-nyc-v-bp_2018-11-15.pdf\">NRDC on behalf of Environmental Justice groups<\/a>, <a href=\"https:\/\/blogs2.law.columbia.edu\/climate-change-litigation\/wp-content\/uploads\/sites\/16\/case-documents\/2018\/20181115_docket-18-2188_amicus-brief.pdf\">Catherine Sharkey of NYU<\/a>, and a coalition of attorneys general.
