A spokesman for Administrator Scott Pruitt told the <a href=\"https:\/\/www.nytimes.com\/2017\/05\/07\/us\/politics\/epa-dismisses-members-of-major-scientific-review-board.html\">media<\/a> that he is considering replacing the fired academics with industry representatives as he \u201cbelieves we should have people on the board who understand the impact of regulations on the regulated community.\u201d These events have prompted questions about the law governing membership of the SAB.<\/p>\n<p>As its name suggests, the SAB is an advisory committee, established to provide EPA with input on scientific matters. It was first established in 1978 by then EPA Administrator, Douglas M. Costle, pursuant to the Environmental Research, Development, and Demonstration Authorization Act (\u201cERDDA Act\u201d). This blog post offers a short primer on the ERDDA, and on the composition of the SAB, the qualifications of its members, and rules on impartiality and conflicts of interest.<\/p>\n<p><!--more--><\/p>\n<p><strong>Composition of the SAB<\/strong><\/p>\n<p>Under section 8(b) of the ERDDA Act (codified at <a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/USCODE-2010-title42\/pdf\/USCODE-2010-title42-chap55-subchapIII-sec4365.pdf\">42 U.S.C. \u00a7 4365<\/a>), the SAB must consist of at least nine members appointed by the EPA Administrator. Each year, EPA\u2019s SAB Staff Office solicits nominations from the public for experts to be appointed to the SAB. The Staff Office reviews the qualifications of each nominee and submits recommendations for new members to the Administrator.<\/p>\n<p>In appointing members to the SAB, the Administrator must comply with the Federal Advisory Committee Act (\u201cFACA\u201d), which applies to all executive advisory committees. The FACA (<a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid%3AUSC-prelim-title5a&amp;saved=%7CZ3JhbnVsZWlkOlVTQy1wcmVsaW0tdGl0bGU1YS1ub2RlMjAtc2VjdGlvbjE%3D%7C%7C%7C0%7Cfalse%7Cprelim&amp;edition=prelim\">5 U.S.C. App 1, \u00a7 5<\/a>) requires committee membership to be \u201cfairly balanced in terms of the point of view represented.\u201d The FACA\u2019s legislative history indicates that this requirement was intended to ensure that \u201cspecial interest groups [cannot] exercise undue influence upon Government through the dominance of advisory committees.\u201d Echoing this language, in <a href=\"https:\/\/casetext.com\/case\/national-nutritional-foods-assn-v-califano-2\">National Nutritional Foods Association v. Califano<\/a>, the Second Circuit Court of Appeals held that committee members must be chosen so that no one interest \u201cdominates.\u201d Thus, for example, it has been <a href=\"https:\/\/journals.sagepub.com\/doi\/pdf\/10.1177\/016224398400900109\">suggested<\/a> that industry representatives on the SAB must be balanced by representatives of the environmental movement.<\/p>\n<p>EPA has <a href=\"https:\/\/yosemite.epa.gov\/sab\/sabproduct.nsf\/WebSABSO\/\">indicated<\/a> that it will appoint, as SAB members, \u201cnon-EPA scientists, engineers, and economists and other social scientists . . . from academia, industry, federal, state, and tribal governments, research institutes, and non-governmental organizations.&#8221; As of May 8, 2017, the SAB consisted of forty seven <a href=\"https:\/\/yosemite.epa.gov\/sab\/sabpeople.nsf\/WebExternal\">members<\/a>, all but ten of whom were from academia. Of the ten non-academics, three were from industry, four were from non-profit public interest organizations, one was an independent consultant, and two were from state environmental agencies.<\/p>\n<p><strong>SAB Member Qualifications<\/strong><\/p>\n<p>Section 8(b) of the ERDDA Act (<a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/USCODE-2010-title42\/pdf\/USCODE-2010-title42-chap55-subchapIII-sec4365.pdf\">42 U.S.C. \u00a7 4365(b)<\/a>) requires each member of the SAB to be \u201cqualified by education, training, and experience to evaluate scientific and technical information on matters referred to\u201d it. Beyond this little guidance has been provided on the precise qualifications required by SAB members. There is, for example, no requirement that members possess a particular academic degree or have particular professional experience. EPA has, however, repeatedly emphasized the need for members to be independent. For example:<\/p>\n<ul>\n<li>The <a href=\"https:\/\/yosemite.epa.gov\/sab\/sabproduct.nsf\/Web\/sabcharter\/$File\/\">SAB Charter<\/a> indicates that members should be \u201c<u>independent<\/u> experts in the fields of science, engineering, and economics and other social sciences\u201d (emphasis added).<\/li>\n<li><a href=\"https:\/\/yosemite.epa.gov\/sab\/sabproduct.nsf\/Web\/ImplementReorgSAB\/$File\/sab04002.pdf\">Guidance<\/a> issued by EPA\u2019s SAB Staff Office states: \u201cCollectively, the SAB should constitute a distinguished body of scientists, engineers, economists and social scientists who are widely recognized for their record of scholarly and leadership achievement in their respective fields. Members . . . should have demonstrated ability and experience to examine and analyze issues incisively with the highest level of scientific quality, <u>objectivity and integrity<\/u>\u201d (emphasis added).<\/li>\n<li>EPA\u2019s <a href=\"https:\/\/yosemite.epa.gov\/sab\/sabpeople.nsf\/WebExternalCommittee\">Frequently Asked Questions on SAB Membership<\/a> indicate that nominees for appointment to the board are evaluated based on \u201cwhether they have the scientific education, training, and experience to evaluate basic and applied science issues addressed by the [board].\u201d It goes on to state: \u201cEthics considerations and . . . <u>impartiality<\/u> are also important\u201d (emphases added).<\/li>\n<\/ul>\n<p><strong>Ensuring Impartiality and Avoiding Conflicts <\/strong><\/p>\n<p>SAB members are appointed as special government employees and are therefore subject to federal ethics rules. Each member must, before beginning his\/her service and annually thereafter, submit a financial disclosure form to the EPA\u2019s SAB Staff Office. According to the <a href=\"https:\/\/yosemite.epa.gov\/sab\/sabproduct.nsf\/WebBOARD\/Serving%20on%20the%20EPA%20Science%20Advisory%20Board:%20A%20Handbook%20for%20Members%20and%20Consultants\/%24File\/Serving%20on%20the%20EPA%20Science%20Advisory%20Board%20SABSO-12-001.pdf\">Staff Office<\/a>, the form is used by EPA to assess whether the member\u2019s \u201cparticipation in an advisory activity would present a conflict of interest or might raise an appearance of lack of impartiality.\u201d<\/p>\n<p>Federal ethics rules (<a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/USCODE-2012-title18\/pdf\/USCODE-2012-title18-partI-chap11-sec208.pdf\">18 U.S.C. \u00a7 208<\/a> and <a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/CFR-1998-title5-vol3\/pdf\/CFR-1998-title5-vol3-part2640.pdf\">5 C.F.R. Pt. 2640<\/a>) prohibit SAB members from participating in any matter in which they, their immediate family, or their employer has a financial interest. That prohibition is, however, subject to two exceptions. First, an SAB member may participate in a \u201cmatter of general applicability\u201d \u2013 that is, a matter focused on the interests of a discrete and identifiable class of persons (e.g., the development of general regulations, policies, or standards) \u2013 affecting his\/her employer provided it will not have a special or distinct effect on the employer other than as part of a class. The only time the exception does not apply is where the member owns stock in his\/her employer.<\/p>\n<p>Additionally, even if the above exception does not apply, an SAB member may participate in a matter in which he\/she or his\/her employer has a financial interest with the approval of the EPA Administrator. The Administrator may grant such approval if he\/she determines that \u201cthe need for the individual\u2019s service outweighs the potential for a conflict of interest created by the financial interest involved.\u201d<\/p>\n<p><strong>Conclusion<\/strong><\/p>\n<p>Notwithstanding the above, SAB members are <a href=\"https:\/\/yosemite.epa.gov\/sab\/sabproduct.nsf\/WebSABSO\/QsandAsMembership\/$File\/Qs&amp;As\">expected<\/a> to act objectively and avoid conflicts of interest where possible. Ideally, as EPA has itself <a href=\"https:\/\/yosemite.epa.gov\/sab\/sabproduct.nsf\/Web\/sabcharter\/$File\/\">recognized<\/a>, members should be independent of any interested party. That has not always been the case, however. In the 1980s, the Reagan Administration <a href=\"https:\/\/www.upi.com\/Archives\/1983\/03\/01\/A-hit-list-of-EPA-scientific-advisers-that-brands\/1227415342800\/\">came under fire<\/a> for appointing industry representatives to the SAB, while excluding others seen as pro-environment. The George W. Bush Administration also <a href=\"https:\/\/www.nejm.org\/doi\/pdf\/10.1056\/NEJMhpr033416\">reportedly<\/a> increased industry representation on the SAB and other advisory committees. Whether history will repeat itself once more under President Trump remains to be seen.
