This week, the Lower Austrian government\u2019s approval of those plans was struck down by Austria\u2019s Federal Administrative Court (<em>Bundesverwaltungsgericht<\/em>) on the grounds that authorizing the runway would do more harm to the public interest than good, primarily because it would be contrary to Austria\u2019s national and international obligations to mitigate the causes of climate change.<\/p>\n<p><!--more-->Before arriving at its decision, the court examined expected changes in future air traffic, the emissions impacts of those changes, and the extent to which it would be possible for the airport to control or otherwise limit various sources of emissions. It also considered the economic benefits of the additional runway, the adverse impacts of climate change on Austria, and the state of Austria and Europe\u2019s effort to reduce emissions generally and from air traffic in particular. After reviewing several estimates, the court concluded that a third runway would increase Austria\u2019s annual CO2 emissions by between 1.79 and 2.02% by 2025. This is at odds, the court noted, with Austria\u2019s 2020 transport sector emissions reduction target of 2.25%. The court also observed that short-term gains in the form of commerce or jobs were easily outweighed by the likely economic consequences of a destabilized climate.<\/p>\n<p>The legal bases for the court\u2019s decision included domestic and international law. Environmental protection is a right embodied in Austria\u2019s constitution, in the constitution of the region of Lower Austria, and in the EU\u2019s Human Rights Charter. And Austria has articulated its climate change mitigation commitments both by ratifying the Paris Agreement and through its Climate Protection Law, which provides for a schedule of emissions reductions from 2015\u20132020 and beyond.<\/p>\n<p>The parties have six weeks to appeal the decision to Austria\u2019s Constitutional Court.<\/p>\n<p>The full text of the decision (in German) is available <a href=\"https:\/\/www.bvwg.gv.at\/amtstafel\/291_ERKENNTNIS_2.2.17_ee.pdf?5spp26\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n<p><strong>UPDATE<\/strong><\/p>\n<p>The Austrian Constitutional Court overturned the Federal Administrative Court&#8217;s decision, citing multiple errors that led the lower court to improperly give weight to climate change and land use considerations in the balancing test it used to consider the public&#8217;s interest in a third runway. The errors identified by the Constitutional Court included:<\/p>\n<ul>\n<li>misconstruing the Air Traffic Law&#8217;s instruction to consider environmental protection over-broadly by factoring in environmental impacts beyond those directly attributable to air traffic;<\/li>\n<li>wrongly including in emissions projections aircraft emissions attributable to flight segments other than landing and takeoff;<\/li>\n<li>improperly superimposing regional greenhouse gas emissions reduction targets on an analysis of legal rights and obligations under the federal Air Traffic Law; and<\/li>\n<li>misapplication of the Kyoto Protocol and Paris Agreement, which the Constitutional Court explained are the source of international obligations for Austria but are not generally applicable in the domestic legal context (&#8220;<em>sie erzeugen daher nur eine v\u00f6lkerrechtliche Verpflichtung \u00d6sterreichs und sind innerstaatlich nicht unmittelbar anwendbar<\/em>&#8220;).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>The Constitutional Court&#8217;s decision (in German) is available <a href=\"https:\/\/www.vfgh.gv.at\/downloads\/VfGH_E_875-2017_Verkuendungstext_Flughafen.pdf\">here<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>by Justin Gundlach (Updated on June 29, 2017) Plans for a third runway at the Vienna-Schwechat airport (pictured at right) were first submitted for review by the government of Lower Austria (one of Austria\u2019s 9 regions) in March 2007.
