{"id":4681,"date":"2017-02-08T15:40:05","date_gmt":"2017-02-08T20:40:05","guid":{"rendered":"http:\/\/blogs.law.columbia.edu\/climatechange\/?p=4681"},"modified":"2017-05-11T10:38:29","modified_gmt":"2017-05-11T15:38:29","slug":"environmental-consumer-and-labor-groups-file-lawsuit-challenging-president-trumps-executive-order-on-reducing-regulation-and-controlling-regulatory-costs","status":"publish","type":"post","link":"https:\/\/blogs.law.columbia.edu\/climatechange\/2017\/02\/08\/environmental-consumer-and-labor-groups-file-lawsuit-challenging-president-trumps-executive-order-on-reducing-regulation-and-controlling-regulatory-costs\/","title":{"rendered":"Environmental, Consumer and Labor Groups File Lawsuit Challenging President Trump\u2019s Executive Order on Reducing Regulation and Controlling Regulatory Costs"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><em>Michael Burger and Jessica Wentz<\/em><\/p>\n<p>Last week, we published a <a href=\"https:\/\/blogs.law.columbia.edu\/climatechange\/2017\/02\/01\/trumps-executive-order-on-regulatory-costs-is-not-only-arbitrary-it-is-also-against-the-law\/\" target=\"_blank\" rel=\"noopener noreferrer\">blog entry<\/a> highlighting some of the fundamental legal problems with President Trump\u2019s Executive Order on \u201cReducing Regulation and Controlling Regulatory Costs.\u201d As we noted then, the order \u2013 which instructs agencies to ensure that the cost of regulations promulgated this year are no greater than zero, and to identify two regulations for potential repeal for every new regulation that is proposed \u2013 conflicts with statutory and judicial requirements on how agencies should account for costs and benefits in rulemaking.<\/p>\n<p>Unsurprisingly, groups have decided to take legal action against the Executive Order. Today, the Natural Resources Defense Council, Public Citizen, and the Communications Workers of America filed a lawsuit seeking to block the Executive Order. The <a href=\"https:\/\/www.nrdc.org\/sites\/default\/files\/complaint-filed-by-nrdc-and-partners-in-2-for-1-litigation-20170208.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">complaint<\/a> alleges that the order is unconstitutional\u00a0 in two ways. \u00a0First, the Executive Order violates the separation power because it \u201cexceeds presidential authority and usurps Congress\u2019s legislative authority\u201d by asking agencies to consider factors not specified in or inconsistent with their governing statutes when making decisions about the promulgation or repeal of regulations.\u201d Second, the Executive Order abdicates the President\u2019s core executive duty to \u201ctake care that the law shall be faithfully executed\u201d by \u201cdirecting agencies to violate the law or rendering then unable to regulate as required by the law.\u201d The complaint also alleges that the Executive Order requires agencies to act beyond their legal power (or <em>ultra vires<\/em>) and the Administrative Procedures Act.<\/p>\n<p><!--more--><\/p>\n<p>The complaint cites many specific examples of regulations that are currently under development and would be affected by the Executive Order if the court does not intervene. These include motor vehicle safety standards, standards to protect the health and safety of miners, and Occupational Health and Safety Act (OSHA) standards to protect health care employees and employees in other high-risk environments from exposure to pathogens that can cause significant infectious disease.
