Lamar Smith (R-TX) has engaged in an ongoing campaign for internal National Oceanic and Atmospheric Administration (NOAA) documents and emails, because he believes NOAA has \u201caltered [climate] data to get the results they needed to advance this administration\u2019s extreme climate change agenda.\u201d<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> NOAA has produced some documents to Rep. Smith, but has steadfastly refused to produce NOAA scientists\u2019 email correspondence. (Previous coverage of this dispute is available <a href=\"https:\/\/blogs.law.columbia.edu\/climatechange\/2015\/10\/30\/noaa-refuses-to-produce-internal-communications-to-house-science-committee\/\">here<\/a> and <a href=\"https:\/\/blogs.law.columbia.edu\/climatechange\/2015\/11\/20\/rep-smith-accuses-noaa-of-potentially-violating-scientific-integrity-policies\/\">here<\/a>.)<\/p>\n<p>Now, a group called Judicial Watch has entered the fray. Using the <a href=\"https:\/\/nsarchive.gwu.edu\/nsa\/foia\/aboutfoia-summary.html\">Freedom of Information Act<\/a> (FOIA), the group has sought the same internal emails and other documents that NOAA refused to produce to Rep. Smith. According to a press release by Judicial Watch, NOAA did not respond to the FOIA request.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> On December 2, the group filed a federal FOIA lawsuit in the District Court for the District of Columbia.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p>While the case is pending, Judicial Watch\u2019s press release says that \u201cNOAA called and told Judicial Watch that it would begin searching for documents responsive to Judicial Watch\u2019s FOIA request.\u201d Judicial Watch\u2019s president also stated that \u201cwe have little doubt that the documents will show that the Obama administration put politics before science to advance global warming alarmism.\u201d<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><!--more--><\/p>\n<p>NOAA has already given Rep. Smith all of the data and methodologies he requested, as well as about 100 non-scientist emails.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> However, NOAA has withheld emails reflecting scientists\u2019 internal deliberations, and it has maintained that \u201cthe confidentiality of these communications among scientists is essential to frank discourse\u201d and it \u201cis a long-standing practice in the scientific community to protect the confidentiality of deliberative scientific discourse.\u201d<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> Public letters by major scientific societies, as well as letters signed by over 600 individual scientists \u2013 including former NOAA scientists \u2013 thanked NOAA for protecting the free exchange of scientific ideas.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/p>\n<p>The\u00a0emergence of this lawsuit is of little surprise: cases across the country have attempted to use FOIA and state law equivalents to access publicly-funded researchers\u2019 private correspondence, including currently pending cases in <a href=\"https:\/\/cei.org\/content\/cei-files-foia-lawsuit-against-george-mason-university-denying-existence-records-related\">Virginia<\/a> and <a href=\"https:\/\/blogs.law.columbia.edu\/climatechange\/2015\/03\/31\/arizona-court-upholds-protections-for-scientific-research-and-correspondence\/comment-page-1\/\">Arizona<\/a> (on appeal). Previous cases in <a href=\"https:\/\/www.washingtonpost.com\/blogs\/local\/wp\/2014\/04\/17\/va-supreme-court-rules-for-u-va-in-global-warming-foia-case\/\">Virginia<\/a> and <a href=\"https:\/\/blogs.law.columbia.edu\/climatechange\/2015\/08\/29\/wv-decision-on-academic-freedom-versus-freedom-of-information-laws\/\">West Virginia<\/a> generally upheld protections for researchers\u2019 correspondence. Meanwhile, an earlier FOIA lawsuit for NASA climate scientists\u2019 emails before the <a href=\"https:\/\/www.scribd.com\/doc\/73196758\/ATI-NASA-Notice\">District Court for the District of Columbia<\/a> \u2013 the same court considering this newest case \u2013 yielded production of a redacted subset of the requested emails, and the case was settled by the parties.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/p>\n<p><em>Lauren Kurtz is the Executive Director of the <a href=\"https:\/\/climatesciencedefensefund.org\">Climate Science Legal Defense Fund<\/a>, which seeks to protect the scientific endeavor.
