Lamar Smith (R-TX), chair of the House Science Committee, who sought internal NOAA communications relating to a recent climate change study.<\/p>\n<p>The study by NOAA scientists, <a href=\"https:\/\/www.sciencemag.org\/content\/348\/6242\/1469.full\">published in <em>Science<\/em><\/a> in June 2015, found that global temperatures have increased faster than had previously been thought.\u00a0 In particular, the study found there were data errors in some ocean surface measurements, and corrections to the datasets yielded greater recent temperature increases than earlier studies had indicated.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>\u00a0 In a news\u00a0piece, <em>Nature<\/em> wrote that the \u201cstudy contradicts previous findings \u2013 often cited by global-warming sceptics \u2013 suggesting that warming has slowed since the 1990s.\u201d<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a>\u00a0 (A graphic comparing the new dataset with the old dataset, which already contained some corrections, is available <a href=\"https:\/\/cdn.arstechnica.net\/wp-content\/uploads\/2015\/06\/noaa_temp_update1.png\">here<\/a>.)<\/p>\n<p>Rep. Smith himself has been critical of evidence supporting man-made climate change, and he once suggested that climate scientists colluded \u201cto hide contradictory temperature data.\u201d<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a>\u00a0 In a July 14, 2015 letter to NOAA, he claimed the new study was \u201cin direct disagreement\u201d with previous studies, and he stated that \u201c[w]hen corrections to scientific data are made, the quality of the analysis and decision-making is brought into question.\u00a0 The conclusions brought forth in this new study have lasting impacts and provide the basis for further action through regulations.\u201d\u00a0 He requested copies of all data \u201crelated to this study and the updated global datasets, including the methods of analysis used to adjust data\u201d; all documents and communications relating to the data corrections (over an eighteen month period); and all information related to NOAA\u2019s plans to make the data public.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n<p>NOAA responded by \u201cpointing him to the relevant data and methods, all of which had already been publicly available\u201d but it declined to provide any internal communications. <a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a>\u00a0 Rep. Smith sent two additional letters in September, seeking additional data and reiterating his desire for internal communications.\u00a0 NOAA provided more data and information about the study, including in-person briefings to explain the science.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> \u00a0However, it never produced the internal communications Rep. Smith wanted.<\/p>\n<p>On October 13, Rep. Smith issued a subpoena to NOAA seeking the internal communications.\u00a0 (New rules passed this January allow chairs on some House committees \u2013 including the House Science Committee \u2013 to issue subpoenas unilaterally.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a>)\u00a0 The subpoena claimed that the internal \u201cdocuments and communications are central to the Committee\u2019s oversight of NOAA\u2019s decision to readjust historical temperature records. . . . NOAA\u2019s decision to readjust historical temperature records has broad national implications.\u201d<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><!--more--><\/p>\n<p>The ranking minority member on the House Science Committee, Rep. Eddie Bernice Johnson (D-TX), responded to Rep. Smith\u2019s subpoena with a pointed letter on October 23, in which she described the subpoena as \u201cfurthering a fishing expedition.\u201d<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a>\u00a0 Rep. Johnson wrote that \u201cNOAA, rightfully, has been reluctant to waste their time and resources, not to mention break confidence with their superb research scientists by responding\u201d to requests for internal communications.\u00a0 She quoted the <em>Washington Post<\/em> to say that \u201c[a]cademics must feel comfortable sharing research, disagreeing with colleagues and proposing conclusions \u2013 not all of which will be correct \u2013 without fear that those who dislike their findings will conduct invasive fishing expeditions in search of a pretext to defend them.\u201d\u00a0 Rep. Johnson stated it was \u201can inquiry that seems more designed to harass climate scientists than to further any legitimate legislative purpose.\u00a0 This is a serious misuse of Congressional oversight powers.\u201d<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a><\/p>\n<p>Dr. Benjamin Santer, a climate scientist at the federal Lawrence Livermore National Laboratory, took the \u201cfishing\u201d comparison a step further and said this \u201cis not a fishing expedition \u2013 this is a trawling expedition.\u201d\u00a0 He expanded that \u201cI don\u2019t think this is the kind of issue a congressional staffer with little or no scientific training can adjudicate on.\u201d\u00a0 Instead, he said the subpoena is \u201clooking for an unfortunate phrasing in emails to cast doubt on an entire scientific endeavor.\u201d<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p>NOAA itself responded to the subpoena on October 27 with a letter citing numerous briefings, datasets, studies, and other information it gave the committee over the past few months, and provided additional background information, but it again declined to turn over any emails or other deliberative communications.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a>\u00a0 In a separate statement, NOAA said that \u201cthe confidentiality of these communications among scientists is essential to frank discourse\u201d and it \u201cis a long-standing practice in the scientific community to protect the confidentiality of deliberative scientific discourse.\u201d<a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a><\/p>\n<p>Rep. Smith countered with a statement claiming it was \u201csuspicious\u201d that NOAA \u201calters data to get the politically correct results they want and then refuses to reveal how those decisions were made.\u00a0 NOAA needs to come clean about why they altered the data to get the results they needed to advance this administration\u2019s extreme climate change agenda.\u201d\u00a0 Rep. Smith claimed NOAA \u201chas yet to identify any legal basis for withholding these documents\u201d and stated that the \u201cCommittee intends to use all tools at its disposal to undertake its Constitutionally-mandated oversight responsibilities.\u201d<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a><\/p>\n<p><em>Lauren Kurtz is the Executive Director of the <a href=\"https:\/\/climatesciencedefensefund.org\/\">Climate Science Legal Defense Fund<\/a>, which seeks to protect the scientific endeavor.\u00a0 CSLDF has provided legal assistance to help an individual climate scientist respond to a <\/em><a href=\"https:\/\/blogs.law.columbia.edu\/climatechange\/2015\/10\/14\/climate-scientist-threatened-with-investigation-by-congress\/\"><em>separate inquiry<\/em><\/a><em> by Rep.
