Seeking Climate Scientists\u2019 Emails for \u201cTransparency\u201d Has Been Secretly Paid for by the Coal Industry"},"content":{"rendered":"<p>In March 2015, an Arizona trial court validated the University of Arizona\u2019s denial of massive records requests by Energy &amp; Environment Legal (\u201cE&amp;E Legal\u201d), which sought 13 years of climate scientists\u2019 emails under Arizona open records laws.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>\u00a0 E&amp;E Legal, formerly named the American Tradition Institute, claimed it wanted these emails for its \u201ctransparency project.\u201d<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> \u00a0The group has been described as having \u201ca core mission of discrediting climate science and dismantling environmental regulations,\u201d<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> and E&amp;E Legal openly admitted its litigation was seeking documents it could use to embarrass researchers.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a>\u00a0 Many in the scientific community applauded the court\u2019s ruling,<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> but E&amp;E Legal was less pleased and it recently appealed the decision.<\/p>\n<p>In its appeal, E&amp;E Legal claims that the trial court misinterpreted Arizona\u2019s open records laws, which balance duties of government transparency with protections deemed in \u201cthe best interests of the state.\u201d<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a>\u00a0 In particular, E&amp;E Legal claims that the trial court erred by giving deference to the University\u2019s determination, and the court improperly considered whether the University had \u201cabuse[d] its discretion or act[ed] arbitrarily or capriciously\u201d in withholding the emails.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> \u00a0Instead, E&amp;E Legal claims, the trial court should have considered both sides\u2019 arguments equally and analyzed them <em>de novo<\/em>.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a> \u00a0E&amp;E Legal has asked for a remand to the trial court for reanalysis or, in the alternative, a new analysis by the appellate court.<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a><\/p>\n<p>E&amp;E Legal has been called \u201ca free-market think tank that wants the public to believe human-caused global warming is a scientific fraud,\u201d<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> and its tactics include \u201cfiling nuisance suits to disrupt important academic research.\u201d<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a>\u00a0 The group also \u201chas connections with the Koch brothers, Art Pope and other conservative donors seeking to expand their political influence.\u201d<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a><\/p>\n<p>Recent bankruptcy filings by coal producer Alpha Natural Resources (\u201cANR\u201d), analyzed by <em>The Intercept<\/em>, also reveal that E&amp;E Legal\u2019s work has been funded by the coal industry.<a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a>\u00a0 These bankruptcy filings list line item descriptions of ANR contractors and grant recipients, which includes distributions to E&amp;E Legal attorney Christopher Horner, as well the Free Market Environmental Law Clinic (\u201cFMELC\u201d), which operates as litigation counsel for E&amp;E Legal.<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a>\u00a0 (FMELC\u2019s business address is also the home of David Schnare, the general counsel for E&amp;E Legal, and FMELC is staffed solely by attorneys who also work for E&amp;E Legal.<a href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a>)\u00a0 A representative from the Union of Concerned Scientists described the ANR money to FMELC and Horner as essentially \u201cfunding the harassment of scientists.\u201d<a href=\"#_ftn16\" name=\"_ftnref16\">[16]<\/a>\u00a0 Chris Horner was also a featured speaker at the 2015 Coal and Investment Leadership Forum, an invitation-only retreat that brings together coal industry executives, Republican donors, and other \u201cstakeholders.\u201d<a href=\"#_ftn17\" name=\"_ftnref17\">[17]<\/a><\/p>\n<p><!--more-->Despite the groups\u2019 transparency directives, FEMC director and E&amp;E Legal general counsel David Schnare declined to give reporters additional details on ANR funding, and sent an email \u201cneither confirming nor denying that Horner or his organizations have received funding from the coal giant.\u201d<a href=\"#_ftn18\" name=\"_ftnref18\">[18]<\/a>\u00a0 Horner has previously declined to comment on his relationship with coal companies.<a href=\"#_ftn19\" name=\"_ftnref19\">[19]<\/a>\u00a0 Schnare told reporters that \u201cnearly all\u201d of their donors \u201crequest that we not disclose their names,\u201d and noted that IRS regulations do not require disclosure.<a href=\"#_ftn20\"
