margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Italian Scientists\u2019 Convictions for Not Predicting Earthquake Reversed<\/p>\n<p>In the early hours of April 6, 2009, a magnitude 6.3 earthquake struck central Italy, with the epicenter near the medieval city of L\u2019Aquila.\u00a0 The 20-second earthquake left over 300 people dead, over 1,500 injured, and over 65,000 homeless in L\u2019Aquila and 45 surrounding towns.\u00a0<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>\u00a0<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n<p>In a <a href=\"https:\/\/blogs.law.columbia.edu\/climatechange\/2012\/10\/24\/seven-italty-scientists-charged-with-manslaughter-for-failing-to-predict-2009-earthquake\/\">2012 decision<\/a> widely condemned by the international scientific community, an Italian judge ruled that six scientists and one government official had committed manslaughter by failing to inform local residents of the risks prior to the earthquake.\u00a0 The judge sentenced the seven defendants to six years in prison, permanently barred them from public service, and ordered them to pay court costs and damages totaling roughly $10.2 million.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> \u00a0Last month, an appellate court overturned the six scientists\u2019 convictions; it upheld the government official\u2019s conviction, although it reduced his sentence to two years on \u201csuspension,\u201d meaning he only will serve time if he commits another crime.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n<p>Some early media reports claimed that science itself had been on trial but the initial ruling, while still disturbing to many observers, was a bit more complicated:\u00a0 The trial judge (Italy does not generally use juries) found that the seven defendants were criminally negligent because of their participation in a government meeting on seismic risks the week before the earthquake struck.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> \u00a0Frequent tremors had been occurring near L\u2019Aquila for months, and the scientists advised the government official and others that a large earthquake was possible but unlikely.\u00a0 Separately, the government official promulgated a message that there was \u201cno danger\u201d of an earthquake and he theorized the tremors even indicated \u201cit\u2019s a favorable situation because of the continuous discharge of energy\u201d (a claim most seismologists dispute).<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/p>\n<p>The prosecution alleged that the defendants had failed to fulfill their duty to supply residents \u201call the information available to the scientific community on the seismic activity of the last few weeks\u201d before the earthquake.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a>\u00a0 The trial judge agreed, finding that the defendants had directly contributed to the deaths of at least 29 specific people who had stayed in their homes as a result of the government official\u2019s message but normally would have evacuated.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a>\u00a0 The defendants appealed, and under Italian law, they were free during the appeal process.<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a><\/p>\n<p>The appellate court reversed the scientists\u2019 convictions, and shortened the government official\u2019s conviction.\u00a0 Although lessened, the official\u2019s conviction remained because of his role in reassuring the public with claims that were contradicted by science, which included a recommendation that locals sit back and enjoy a glass of wine instead of worrying about earthquakes.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a>\u00a0 While the trial judge found that the scientists had implicitly supported the official\u2019s mistaken statements \u2013 or had not done enough to counteract them \u2013 and were therefore equally guilty, the appellate court announced that any evidence of crimes by the scientists \u201cdoes not exist.\u201d<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p>Scientists the world over have expressed relief, and the attorney for one scientist defendant said his client could never understand why he was \u201cput on trial for having expressed a scientific opinion.\u201d<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a>\u00a0 The American Geophysical Union, an international association of geophysicists, released a statement that the \u201cacquittal is an important step in sanctioning the role scientists play in advising governments and communicating the results of their research to the public. \u00a0Scientists must be able to exchange data and information in an unfettered manner and make good-faith efforts to present the results of their research without fear of prosecution.\u201d<a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a>\u00a0 However, many L\u2019Aquila residents were upset with the appellate court\u2019s decision, shouting \u201cShame!
