{"id":2415,"date":"2013-12-04T11:24:48","date_gmt":"2013-12-04T16:24:48","guid":{"rendered":"http:\/\/blogs.law.columbia.edu\/climatechange\/?p=2415"},"modified":"2013-12-04T11:24:48","modified_gmt":"2013-12-04T16:24:48","slug":"rggi-outlines-its-111d-vision-to-epa","status":"publish","type":"post","link":"https:\/\/blogs.law.columbia.edu\/climatechange\/2013\/12\/04\/rggi-outlines-its-111d-vision-to-epa\/","title":{"rendered":"RGGI Outlines Its 111(d) Vision to EPA"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>by Shelley Welton, Deputy Director<a href=\"https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2013\/12\/Smoke-stack.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-2420\" alt=\"Smoke stack\" src=\"https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2013\/12\/Smoke-stack-201x300.jpg\" width=\"138\" height=\"206\" srcset=\"https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2013\/12\/Smoke-stack-201x300.jpg 201w, https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2013\/12\/Smoke-stack.jpg 336w\" sizes=\"auto, (max-width: 138px) 100vw, 138px\" \/><\/a><\/p>\n<p>On December 2<sup>nd<\/sup>, commissioners, secretaries and directors of environmental and energy agencies from states within the <a href=\"https:\/\/www.rggi.org\/\">Regional Greenhouse Gas Initiative<\/a> (RGGI) filed <a href=\"https:\/\/www.rggi.org\/docs\/RGGI_States_111d_Letter_Comments.pdf\">comments<\/a> to EPA on the agency\u2019s forthcoming regulations for greenhouse gases from existing power plants.\u00a0 RGGI is understandably anxious that the work its participating states have put into developing (and recently, <a href=\"https:\/\/blogs.law.columbia.edu\/climatechange\/2013\/02\/08\/rggi-program-review-results-in-proposal-for-significantly-lower-cap\/\">reforming<\/a>) the program not be lost once EPA issues its new regulations.\u00a0 Accordingly, RGGI\u2019s filing encourages the EPA to design its regulations in a way that allows RGGI\u2019s program to count for compliance, and in a way that rewards states that have taken early action.<\/p>\n<p>This summer, President Obama <a href=\"https:\/\/blogs.law.columbia.edu\/climatechange\/2013\/06\/26\/deadlines-for-regulating-new-existing-power-plant-carbon-emissions-set-by-obama-memo\/\">set forward ambitious deadlines<\/a> for EPA to regulate greenhouse gas emissions from both new and existing sources under the Clean Air Act.\u00a0 Under \u00a7 111(d) of that Act, once EPA decides to regulate a particular pollutant from <i>new <\/i>sources, states are required to develop plans for how they will regulate <i>existing<\/i> sources of that pollutant. EPA sets forth criteria that these plans must meet and reviews the plans for compliance.\u00a0 RGGI hopes that EPA will establish criteria that allow its existing cap-and-trade program to double as a compliance mechanism for \u00a7 111(d) greenhouse gas regulations.<\/p>\n<p>Despite, or perhaps in part because of, this \u201csurvivalist\u201d focus, a few interesting points emerge from RGGI\u2019s filing:<br \/>\n<!--more--><br \/>\n<b>Magnitude of Emissions Reductions: <\/b>RGGI states hold their program up as an example of the <i>magnitude <\/i>of cuts that EPA should demand from existing sources elsewhere in the country.\u00a0 According to the filing, RGGI is on track to achieve regional emissions reductions of 50% below 2005 levels by 2020 (an achievement aided in part by the recession and plunging natural gas prices, but nevertheless considerably more ambitious than President Obama\u2019s Copenhagen Pledge of 17% below 2005 levels by 2020).<\/p>\n<ul>\n<li>RGGI notes that this level of reductions will be achieved through two channels: (1) measures that reduce the demand for fossil fuels, like energy efficiency and renewable energy investments; and (2) measures that increase the efficiency of fossil fuel generation, including retrofitting and switching more to natural gas.\u00a0 It is an open question whether or not EPA will decide to pursue a \u00a7 111(d) program that includes both of these channels, as opposed to just the latter.\u00a0 Reductions achievable through increasing the efficiency of fossil fuels alone would presumably be much more modest in scale.<\/li>\n<\/ul>\n<p><b>Target-setting methodology: <\/b>Much of the debate around the anticipated \u00a7 111(d) regulations has revolved around whether its targets should be <b>mass-based<\/b> or <b>rate-based<\/b>.\u00a0 Under a mass-based system, states would be given a total tonnage of greenhouse gases they could emit.\u00a0 Under a rate-based system, states would be given a pounds\/megawatt hour target that their overall fleets had to meet on average (akin to carbon intensity targets).<\/p>\n<ul>\n<li>As a mass-based system itself, RGGI unsurprisingly advocates that EPA allow mass-based approaches to comply with \u00a7 111(d).\u00a0 The filing focuses on the advantage of simplicity that a cap-and-trade, mass-based system provides: compliance can be measured through the overall number of allowances a source has, as compared to their reported emissions.\u00a0 In contrast, rate-based targets require measuring all claimed energy efficiency improvements separately, raising far more monitoring and verification challenges.<\/li>\n<\/ul>\n<ul>\n<li>However, RGGI also suggests that it might be most equitable to <i>begin <\/i>with a single rate-based target for each state, such that states that have already made progress towards reducing emissions intensity could be rewarded for having done so.\u00a0 But the filing emphasizes that if EPA utilizes this approach, it should provide the states with a clear methodology of how they can convert these emissions rates into mass-based emission budgets.<\/li>\n<\/ul>\n<p><b>A Regional Focus: <\/b>RGGI emphasizes the appeal of a regional approach, which allows for regional averaging rather than requiring states to meet assigned limits individually. The filing notes that a regional approach best accords with the current regional design of electricity markets, and that efficiency can be gained by allowing a region to collectively achieve targets by locating cleaner generation where it is most cost-effective and investing in energy efficiency anywhere within the region.<\/p>\n<p><b>Cap-and-Invest as \u201cBest System of Emission Reduction\u201d: <\/b>Rather than using the typical moniker \u201ccap and trade,\u201d RGGI bills itself as a \u201ccap and invest\u201d program.\u00a0 In so doing, it highlights the impressive facts that RGGI states have chosen to auction the vast majority of CO<sub>2<\/sub> allowances, and that states have by and large used the resulting proceeds to fund energy efficiency and renewable energy programs.\u00a0 RGGI credits this targeted investment of auction proceeds for much of its success in stimulating economic growth at the same time as it caps carbon emissions.\u00a0 RGGI goes on to suggest that its successes qualify it as a \u201cbest system of emission reduction\u201d upon which EPA should base its \u00a7 111(d) regulations.<a title=\"\" href=\"#_ftn1\">[1]<\/a><\/p>\n<p>RGGI\u2019s compliance filing makes a strong policy case for designing regulations that allow for states to utilize a regional cap-and-trade approach for compliance. \u00a0It remains to be seen whether EPA will decide that it is also a legally viable pathway.\u00a0 Opponents are likely to argue that a cap-and-trade system like RGGI, which focuses not on individual plants\u2019 performance but on the power sector as a whole, is simply too broad an approach to be countenanced under the Clean Air Act\u2019s requirement that states establish \u201cstandards of performance\u201d based on the \u201cbest system of emission reduction.\u201d<\/p>\n<p>In making its case to EPA, might the region also be trying to lay the foundations for a broader RGGI in the future?
