{"id":2278,"date":"2013-09-18T12:47:02","date_gmt":"2013-09-18T17:47:02","guid":{"rendered":"http:\/\/blogs.law.columbia.edu\/climatechange\/?p=2278"},"modified":"2013-10-17T12:03:47","modified_gmt":"2013-10-17T17:03:47","slug":"new-cccl-paper-analyzes-clean-air-act-flexibility","status":"publish","type":"post","link":"https:\/\/blogs.law.columbia.edu\/climatechange\/2013\/09\/18\/new-cccl-paper-analyzes-clean-air-act-flexibility\/","title":{"rendered":"New CCCL Paper Analyzes Clean Air Act Flexibility"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><b>New CCCL Paper Analyzes Clean Air Act Flexibility <\/b><\/p>\n<p>CCCL has published a <a href=\"https:\/\/web.law.columbia.edu\/sites\/default\/files\/microsites\/climate-change\/files\/Publications\/Collaborations-Visiting-Scholars\/IMPEAQ%20Final_Sept%202013.pdf\">new white paper<\/a> that summarizes our research into the permissibility of states pursuing an integrated, multi-pollutant, flexible approach to air quality planning.\u00a0 More specifically, the non-profit Regulatory Assistance Project (RAP) has recently proposed a new methodology, <i>Integrated, Multi-Pollutant Planning for Energy and Air Quality <\/i>(IMPEAQ), which is designed to allow states to engage in multi-pollutant analysis and cost optimization modeling to achieve efficient gains in air quality.\u00a0 At RAP\u2019s request, we have undertaken an analysis of potential legal issues that might arise during the use of IMPEAQ.<\/p>\n<p>The paper first addresses threshold issues: state authority under the Clean Air Act to voluntarily implement integrated planning using IMPEAQ and the permissibility of using a multi-pollutant approach to air quality planning.\u00a0 It then examines two key issues concerning emerging control measures: how states can use energy efficiency and renewable energy (EERE) programs in their State Implementation Plans (SIPs) and to what extent states may allow novel measures to satisfy the Act\u2019s source-specific control technology requirements.<\/p>\n<p>We find that the IMPEAQ approach would be generally permissible under the Clean Air Act and EPA policy, given the wide discretion states have to develop their own air quality plans and to choose the control measures they wish to use in their SIPs.\u00a0 Our analysis also suggests that there is room under the Act\u2014at least as it is currently construed\u2014for states to allow offsite EERE programs to substitute for site-specific technology controls in many instances.
