{"id":2251,"date":"2013-08-20T10:42:05","date_gmt":"2013-08-20T15:42:05","guid":{"rendered":"http:\/\/blogs.law.columbia.edu\/climatechange\/?p=2251"},"modified":"2013-08-20T10:42:45","modified_gmt":"2013-08-20T15:42:45","slug":"export-import-bank-sued-by-environmental-groups-for-coal-export-loan-guarantee","status":"publish","type":"post","link":"https:\/\/blogs.law.columbia.edu\/climatechange\/2013\/08\/20\/export-import-bank-sued-by-environmental-groups-for-coal-export-loan-guarantee\/","title":{"rendered":"Export-Import Bank Sued by Environmental Groups for Coal Export Loan Guarantee"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>By Allie Bollman, Summer Intern<\/p>\n<p>Numerous environmental groups, represented by attorneys from Earthjustice, have filed a <a href=\"https:\/\/earthjustice.org\/sites\/default\/files\/exim-complaint-stamped.pdf\">lawsuit<\/a> against the Export-Import Bank over the Bank\u2019s approval of a $90 million loan guarantee in support of Xcoal\u2019s mining, transport, and export of coal without preparing an environmental impact statement.\u00a0 The lawsuit, filed July 31, argues that the loan guarantee should be declared void, as the Bank\u2019s failure to consider health and environmental impacts before approving the loan violates the National Environmental Policy Act (NEPA).<\/p>\n<p>The lawsuit focuses specifically on the environmental impacts within the United States, stating that, \u201cXcoal\u2019s federally-funded coal export activities involve brokering sales of coal from mines in Appalachia; transporting coal by rail from those mines to export facilities in Baltimore and Hampton Roads; unloading, storing, and loading coal onto ships at the ports; and shipping coal from these port terminals to its customers\u2019 port facilities. Each step of this export process causes numerous adverse effects on human health and the environment.\u201d \u00a0The complaint does not mention the end-use of the coal or any emissions that it will generate offshore.<\/p>\n<p><!--more--><\/p>\n<p>In 2002, Friends of the Earth, one of the environmental groups involved in this current lawsuit, <a href=\"https:\/\/www.greenpeace.org\/usa\/Global\/usa\/report\/2009\/2\/plaintiff-s-complaint.pdf\">sued<\/a> the Overseas Private Investment Corporation and the Export-Import Bank for failing to consider the environmental impacts caused by carbon dioxide emissions from projects they fund and assist abroad, as those projects \u201cwill result in the annual emission of billions of tons of greenhouse gases (primarily, carbon dioxide) \u2013 emissions equivalent to almost two-thirds of U.S. annual domestic carbon dioxide emissions.\u201d\u00a0 In that case, the Plaintiffs argued that while the fossil fuels may be burned abroad, the emissions will impact the Unites States regardless.\u00a0 The <a href=\"https:\/\/www.climatelaw.org\/cases\/country\/us\/eca\/settlement\/\">settlement<\/a> in 2009 required the Export-Import bank to take carbon dioxide emissions into account when evaluating fossil fuel projects, established a goal of reducing greenhouse gases by 20% over the next 10 years for OPIC, and included a commitment by both agencies to increase financing for renewable energy projects.<\/p>\n<p>It\u2019s interesting to note the profound difference between these two lawsuits- while the earlier case focused on assistance that led to emissions abroad, the current lawsuit focuses entirely on impacts of coal production and transport within the United States, without any mention of the effects of an estimated $1 billion worth of coal being consumed in China, Japan, and South Korea.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Allie Bollman, Summer Intern Numerous environmental groups, represented by attorneys from Earthjustice, have filed a lawsuit against the Export-Import Bank over the Bank\u2019s approval of a $90 million loan guarantee in support of Xcoal\u2019s mining, transport, and export of coal without preparing an environmental impact statement.\u00a0 The lawsuit, filed July 31, argues that the [&hellip;]<\/p>\n","protected":false},"author":918,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[5680,5532,5673,5676],"tags":[],"class_list":{"0":"post-2251","1":"post","2":"type-post","3":"status-publish","4":"format-standard","6":"category-clean-energy","7":"category-climate-disclosures","8":"category-litigation","9":"category-nepa","10":"czr-hentry"},"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 -
