{"id":171,"date":"2010-07-28T14:03:17","date_gmt":"2010-07-28T19:03:17","guid":{"rendered":"http:\/\/blogs.law.columbia.edu\/climatechange\/?p=171"},"modified":"2013-07-19T12:30:19","modified_gmt":"2013-07-19T17:30:19","slug":"new-house-senate-spill-bills-have-little-or-nothing-on-climate","status":"publish","type":"post","link":"https:\/\/blogs.law.columbia.edu\/climatechange\/2010\/07\/28\/new-house-senate-spill-bills-have-little-or-nothing-on-climate\/","title":{"rendered":"New House, Senate Spill Bills Have Little or Nothing on Climate"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>by Hannah Chang<\/p>\n<p>On Tuesday, July 27, oil spill response bills were introduced in both the House and Senate.\u00a0 These bills are a legislative response to the Deepwater Horizon disaster but also contain the remnants of comprehensive energy and climate change legislation that was <a href=\"https:\/\/www.nytimes.com\/2010\/07\/23\/us\/politics\/23cong.html\">shelved<\/a> by Senate Majority Leader Harry Reid on July 22.\u00a0 According to President Obama, the severely pared-down clean energy provisions of the oil spill legislation would be \u201c<a href=\"https:\/\/green.blogs.nytimes.com\/2010\/07\/27\/house-and-senate-roll-out-spill-bills\">an important step in the right direction<\/a>\u201d towards future comprehensive climate legislation.\u00a0 Given that the 238-page House bill introduced by Rep. Rahall of West Virginia has no clean energy or energy efficiency provisions at all, and that the 409-page Senate bill never once mentions climate change, characterization of these packages as even \u201ca step,\u201d much less an important one, towards clean energy reform and climate change legislation is optimistic to say the least.<\/p>\n<p>This blog is the first of three in a series that will address the very few climate change-related provisions of the newly-introduced spill bills.\u00a0 The House bill focuses narrowly on oil spill response.\u00a0 The Senate bill is only slightly more pertinent to climate change and contains two sections relevant to the reduction of greenhouse gases: Division B \u201cReducing Oil Consumption and Improving Energy Security\u201d (addressing clean vehicles) and Division C \u201cClean Energy Jobs and Consumer Savings\u201d (creating a rebate program for home retrofits that would increase energy efficiency).\u00a0 The next two blogs in this series will closely analyze Divisions B and C of the Senate bill.<\/p>\n<p>As the following shortened Table of Contents indicates, the House bill, <a href=\"https:\/\/www.politico.com\/static\/PPM130_clear_combined_-_finaljuly28.html\">H.R. 3534<\/a> entitled the \u201cConsolidated Land, Energy, and Aquatic Resources Act of 2010\u201d (CLEAR), focuses on oil spill response, including reform of the Department of Interior, reform of the Outer Continental Shelf Lands Act, and provisions for improved regional coordination and oil spill accountability.<\/p>\n<ul>\n<li>Title I: <em>Creation of New Department of the Interior Agencies <\/em>(\u00a7\u00a7 101-108, p. 9-37)<\/li>\n<li>Title II: <em>Federal Oil and Gas Development <\/em>\n<ul>\n<li>Subtitle A: <em>Safety, Environmental, and Financial Reform of the Outer Continental Shelf Lands Act <\/em>(\u00a7\u00a7 201-223, p. 38-105)<\/li>\n<li>Subtitle B: <em>Royalty Relief for American Consumers <\/em>(\u00a7\u00a7 241-243, p. 105-110)<\/li>\n<\/ul>\n<\/li>\n<li>Title III: <em>Oil and Gas Royalty Reform <\/em>(\u00a7\u00a7 301-320, p. 110-125)<\/li>\n<li>Title IV: in the House bill, and climate change is mentioned exactly once.\u00a0 Section 605 establishing an Ocean Resources Conservation and Assistance Fund would allow the Secretary of Interior to use these funds and to award grants for activities, including \u201cactivities to improve the ability of [ocean, coastal, and Great Lakes] ecosystems to become more resilient, and to adapt to and withstand the impacts of climate change and ocean acidification.\u201d\u00a0 H.R. 3534, p. 160. \u00a0In short, the House bill doesn\u2019t even begin to take steps to address clean energy reform and greenhouse gas reduction.<\/p>\n<p>The as-yet unnumbered <a href=\"https:\/\/democrats.senate.gov\/pdfs\/The_Clean_Energy_Jobs_and_Oil_Company_Accountability_Act_of_2010.pdf\">Senate bill<\/a>, entitled the \u201cClean Energy Jobs and Oil Company Accountability Act of 2010,\u201d also focuses largely on oil spill response, but does include two discrete sections that limitedly address GHG reductions through promotion of clean vehicles and improved energy efficiency in homes.\u00a0 The following shortened Table of Contents gives a sense of the bill\u2019s scope.<\/p>\n<ul>\n<li>Division A: <em>Oil energy security (Division B\u2019s program promoting natural gas and electric vehicles) and to create clean energy jobs (Division C\u2019s home retrofit program).\u00a0 Climate change itself is not once mentioned in the bill\u2019s 409 pages, although reduction of fossil fuel use and GHG emissions are mentioned as goals of the electric vehicle program (<em>see <\/em>p. 231, 255).\u00a0 Title XX of Division B, which would incentivize the development of natural gas vehicles, derives from the bipartisan NAT GAS Act (<a href=\"https:\/\/www.govtrack.us\/congress\/bill.xpd?bill=s111-1408\">S. 1408<\/a> and <a href=\"https:\/\/www.govtrack.us\/congress\/bill.xpd?bill=h111-1835\">H.R. 1835<\/a>) introduced in both houses of Congress last year.\u00a0 Division C relating to Home Star similarly derives from previously proposed bipartisan legislation.\u00a0 In fact, the House passed <a href=\"https:\/\/www.govtrack.us\/congress\/bill.xpd?bill=h111-5019\">H.R. 5019<\/a>, the Home Star Energy Retrofit Act of 2010, earlier this year with 12 Republican votes.<\/p>\n<p>The House will likely vote on its oil spill response bill this Friday.\u00a0 Debate in the Senate is expected to begin this week.\u00a0 Any legislation that eventually emerges from these bills will do little for GHG reduction or climate change, unless, perhaps in the lame duck session, some provisions of last year&#8217;s Waxman-Markey bill are injected into conference committee deliberations.\u00a0 If the clean vehicle and home energy efficiency provisions of the Senate bill manage to remain intact, they will provide some limited improvements over business as usual.\u00a0 However, by no means can this legislation be characterized as even a limited energy reform bill, much less a limited climate change
