{"id":11361,"date":"2022-08-09T12:12:47","date_gmt":"2022-08-09T17:12:47","guid":{"rendered":"https:\/\/blogs.law.columbia.edu\/climatechange\/?p=11361"},"modified":"2023-01-31T15:59:50","modified_gmt":"2023-01-31T20:59:50","slug":"new-california-law-allows-state-to-bypass-local-restrictions-in-siting-large-scale-renewables","status":"publish","type":"post","link":"https:\/\/blogs.law.columbia.edu\/climatechange\/2022\/08\/09\/new-california-law-allows-state-to-bypass-local-restrictions-in-siting-large-scale-renewables\/","title":{"rendered":"New California law allows state to bypass local restrictions in siting large-scale renewables"},"content":{"rendered":"<p>On June 30, 2022, the State of California joined the State of New York in adopting legislation that allows state authorities to bypass local laws in permitting large-scale renewable energy projects.<\/p>\n<figure id=\"attachment_11394\" aria-describedby=\"caption-attachment-11394\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2022\/08\/Solar-Farm-ORES.png\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-11394 size-medium\" src=\"https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2022\/08\/Solar-Farm-ORES-300x168.png\" alt=\"\" width=\"300\" height=\"168\" srcset=\"https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2022\/08\/Solar-Farm-ORES-300x168.png 300w, https:\/\/blogs.law.columbia.edu\/climatechange\/files\/2022\/08\/Solar-Farm-ORES.png 399w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><figcaption id=\"caption-attachment-11394\" class=\"wp-caption-text\">Credit: New York Office of Renewable Energy Siting<\/figcaption><\/figure>\n<p>California\u2019s new law, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billPdf.xhtml?bill_id=202120220AB205&amp;version=20210AB20595CHP\">AB 205<\/a>, gives the California Energy Commission (the \u201ccommission\u201d) authority to issue a certificate for any: (a) photovoltaic solar facility, on-shore wind facility, or thermal energy facility not powered by fossil fuels or nuclear fuels, with a generating capacity of at least <strong>50 megawatts<\/strong> (MW); (b)\u00a0energy storage system with a storage capacity of least <strong>200 megawatt hours<\/strong>; (c)\u00a0<strong>electric transmission line<\/strong> from any such generating or storage facility to an interconnected transmission system; and (d)\u00a0facility that manufactures, produces, or assembles wind, solar, or storage systems, with a capital investment of at least <strong>$250,000,000<\/strong> over a period of 5 years. <em>See <\/em>California Public Resources Code \u00a7 25545(b).<\/p>\n<p>AB 205 explicitly supersedes local permitting and local ordinances. Specifically, it provides that the commission\u2019s issuance of a certificate shall:<\/p>\n<ul>\n<li>\u201cbe <strong>in lieu of<\/strong> any permit, certificate, or similar document required by any state, local, or regional agency,\u201d <em>id.<\/em> \u00a7 25545.1(b)(1) (emphasis added); and<\/li>\n<li>\u201c<strong>supersede<\/strong> any applicable statute, ordinance, or regulation of any state, local, or regional agency,\u201d <em>id. <\/em>(emphasis added).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><!--more--><\/p>\n<p>The law further requires that applications be decided expeditiously, providing that:<\/p>\n<ul>\n<li>\u201c[w]ithin <strong>30 days<\/strong> of the submission of the application, the commission shall review the application and make a determination of completeness,\u201d <em>id. <\/em>\u00a7 25545.4(a) (emphasis added); and<\/li>\n<li>\u201cno later than <strong>270 days<\/strong> after the application is deemed complete, or as soon as practicable thereafter, the commission shall determine whether to certify the environmental impact report and to issue a certificate\u201d unless an exception applies, <em>id. <\/em>\u00a7 25545.4(e)(1) (emphasis added).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>In New York State likewise the Accelerated Renewable Energy Growth and Community Benefit Act of 2020, as codified at <a href=\"https:\/\/www.nysenate.gov\/legislation\/laws\/EXC\/94-C\">New York Executive Law \u00a7 94-c<\/a>, charges the Office of Renewable Energy Siting (ORES) with responsibility for permitting \u201cmajor renewable energy facilities,\u201d which include: (a)\u00a0renewable energy facilities of at least <strong>25 MW<\/strong>; (b)\u00a0co-located <strong>energy storage<\/strong> systems; and (c)\u00a0associated <strong>electric transmission<\/strong> systems less than 10 miles in length. <em>See <\/em>Exec. Law \u00a7\u00a094-c(2)(h). Developers of renewable energy facilities of at least <strong>20 MW<\/strong> but less than 25 MW may also submit applications to ORES. <em>Id.<\/em> \u00a7 94-c(4)(g).<\/p>\n<p>While those applying for a permit to construct a major renewable energy facility in New York must \u201cconsult[] with the municipality or political subdivision where the project is proposed to be located\u00a0.\u00a0.\u00a0.\u00a0[concerning] the procedural and substantive requirements of local law,\u201d ORES is authorized to set aside local laws on a case by case basis when deciding whether or not to grant a permit. Specifically, the law provides that ORES:<\/p>\n<blockquote><p><strong>may elect not to apply, in whole or in part, any local law or ordinance<\/strong> which would otherwise be applicable if it makes a finding that, as applied to the proposed major renewable energy facility, it is <strong>unreasonably burdensome<\/strong> in view of the <a href=\"https:\/\/legislation.nysenate.gov\/pdf\/bills\/2019\/S6599\">CLCPA targets<\/a> and the environmental benefits of the proposed major renewable energy facility.<\/p><\/blockquote>\n<p><em>Id.<\/em> \u00a7 94-c(5)(e) (emphasis added).<\/p>\n<p>In addition, New York\u2019s siting law, like California\u2019s new siting law, requires that applications for large-scale renewables be decided expeditiously. In particular, ORES must:<\/p>\n<ul>\n<li>determine within 60 days whether the application is complete, <em>id. <\/em>\u00a7 94-c(5)(b); and<\/li>\n<li>make a final determination on a siting permit within one year of determining that an application is complete or within six months if the project is to be sited on an existing or abandoned commercial use, <em>id. <\/em>\u00a7 94-c(5)(f).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Notwithstanding these two laws, local restrictions remain a major impediment to siting renewable energy projects in the United States. As of March 2022, the Sabin Center had <a href=\"https:\/\/scholarship.law.columbia.edu\/sabin_climate_change\/186\/#:~:text=Sabin%20Center%20for%20Climate%20Change%20Law,-Title&amp;text=Achieving%20lower%20carbon%20emissions%20in,an%20unprecedented%20scale%20and%20pace.\">identified 121 local ordinances<\/a> across the country to block or restrict renewable energy facilities. These policies range from outright bans to temporary moratoria to zoning restrictions so severe that they effectively preclude renewable energy projects. State authorities in California and New York now have the power to bypass such restrictions.
