I am seeking research assistants for a project aimed at developing a blue print for a new global governance regime for finance based on principles I have developed in a recent commentary for the Global Crisis Debate at voxeu.org (available at http://www.voxeu.org/index.php?q=node/3175). The governance regime I propose differs from most approaches currently under discussion, which favor a central agent at the supra-national, such as the IMF or a yet to be created World Financial Organization. Instead, I advocate a regime that comprises of multiple, decentralized, yet inter-linked, financial governance networks with membership in each network by individual countries based on risk preference. Only some tasks, such as systemic risk monitoring, would be conducted centrally.
Students participating in this project will conduct background research, among others, on existing decentralized governance structures that may serve as a model (i.e. GATT; aspects of EU governance; regional trade regimes, etc.); survey the literature and blogosphere ideas and proposals (such as those put forward by Nick Stern and Dani Rodrik) that may inform our blueprint for FGNs; and engage in a critical review of alternative proposals, such as the UN’s expert panel chaired by Prof. Joseph Stiglitz as well as the plans developed by the G20.
A background in international finance is not required. The anticipated duration of the project is 1 June – 24 July 2009 (8 weeks). Students interested in participating in this project should submit a one page statement of interest and a CV to Prof. Pistor at kpisto@law.columbia.edu.

Professor Doyle is seeking one or two students to work on a project with an Israeli NGO, Gisha – Legal Center for Freedom of Movement. Gisha is attempting to assist Palestinians seeking to exercise their transit rights. The goal of the project is to assess current practices, which include application for a transit permit and coordination by a recognized international organization under international consular law and practices. Students should have taken a basic course in International Law and have summer internship funding.

Prof. Metzger is interested in hiring a research assistant for the summer who will assist her in a variety of research projects in the areas of administrative and constitutional law. These include beginning work on an update of the Gellhorn & Byse administrative law casebook, researching recent rulemakings for a project on federalism and administrative law, research for a paper on internal separation of powers limits, and other projects. The RA will be expected to work largely independently with periodic meetings to report on research and discuss any questions or issues, and will be asked to produce memos and other materials over the course of the summer as need arises.

Why does the U.S. Court of Appeals for the Federal Circuit reverse district courts so often? Studies have shown that the Federal Circuit reverses district courts in patent cases between 35 and 50 percent of the time, depending on the study. This is a startlingly high reversal rate. I am working on an intellectual property project exploring whether judicial expertise in patent law, and the technical background (or lack thereof) of Federal Circuit judges, influences this result. I will also be exploring the political influence that the various interest groups within the practicing bar have had on the judicial nominations process. This project is part of a larger study on the political economy of intellectual property law.

Development of database of state and municipal laws on climate change — Prof. Michael Gerrard
Prof. Michael Gerrard is Director of the Center for Climate Change Law. He has developed an on-line database of climate change litigation, posted at www.climatecasechart.com. He would like to accompany it with an on-line database of state and municipal laws on climate change, such as laws concerning green buildings; purchase of energy-efficient products; and the siting of renewable energy facilities such as wind turbines. The student would be part of a team that will assemble, organize and analyze these disparate materials, and prepare them for posting on the web. The ultimate objective of the project is to facilitate the adoption and implementation of these laws on a nationwide basis, so as to ease the nation’s transition to a clean energy economy.

Home-country laws & policies regarding outward investment by emerging-market companies
The Vale Columbia Center’s project on Emerging Market Global Players (EMGP) seeks to address questions about the rapidly increasing outward foreign direct investment (outward FDI) from emerging markets − such as the nature, purpose and implications of these flows from countries hitherto seen mainly as recipients of FDI. The project has begun by publishing annual reports on outward FDI from selected emerging markets: thus far, Brazil, China, India, Israel, Russia and Slovenia (www.vcc.columbia/edu/projects).
For the purpose of both supplementing these annual reports and further extending the work undertaken in the EMGP, the Center would like to engage up to two interns to compile a directory of regulatory measures affecting outward FDI, including laws and policies, in selected emerging markets. Examples of regulations affecting outward FDI would be restrictions on areas of investment (e.g., agriculture), restrictions requiring or forbidding joint ventures with foreign partners, monetary ceilings or ceilings tied to net worth on amount invested abroad, etc.
HOW TO APPLY: Familiarity with at least one of the languages of Southeast Asia, the Middle East, Latin America or Central/Eastern Europe would be needed. Familiarity with the legal systems in these parts of the world would be an asset. The intern would start as soon as possible and would devote up to 20 hours a week to the work.
